1. Welcome to African Lux Safaris

Thank you for choosing African Lux Safaris for your next adventure. As a premier provider of personalized luxury safari experiences, we are committed to delivering an unforgettable journey through Africa’s most stunning landscapes. By booking a safari package with us, you agree to these Terms and Conditions (“The Agreement”), as well as any additional documentation or terms provided by us or our partners. Please read these terms carefully, as they outline your rights, responsibilities, and what you can expect from us. The terms “we,” “us,” “our,” and “African Lux Safaris” refer to African Luxury Safaris & Expeditions, LLC, a California limited liability company. The terms “you” or “the traveler” refer to the customer booking a reservation through our travel specialist. These General Terms and Conditions apply to your travel program.

2. Booking and Payment Terms

Booking your safari with African Lux Safaris begins by contacting us directly or through your Travel Advisor. Our team will work closely with you to craft the perfect itinerary. To secure your reservation, a non-refundable deposit is required. This deposit confirms your booking and holds your place on the tour.

Upon booking, we will provide you with detailed payment instructions and deadlines. Timely payment is essential to avoid the cancellation of your trip. If payments are not made by the specified due dates, we reserve the right to cancel your booking, applying the cancellation fees outlined below.

We accept payments via Visa, MasterCard, Discover, and American Express. Your credit card payment constitutes a binding agreement according to the terms outlined in this agreement. Refunds are processed according to the policies stated herein, and any disputes are limited to cases of fraud.

A deposit of 30% or greater may be required to confirm your booking due to certain components of your safari package (“travel program”). The remaining balance must be paid 90 days before the start date of your safari. If your reservation is made within 90 days of departure, the entire cost of the trip must be paid at the time of confirmation.

3. Pricing and Rates

All prices listed are for land-only arrangements and do not include international airfare unless specified. Prices are subject to change without notice, and we reserve the right to correct any pricing errors. Your land price is guaranteed once we receive your deposit.

Rates for private tours are based on a minimum of two guests. Solo travelers or those traveling alone will incur a higher rate. Should your travel companion cancel, you will be responsible for any applicable single supplement fees.

We can assist with booking international airfare at an additional cost. Please note that baggage fees, seat assignments, and other airline charges are your responsibility and are subject to the airline’s terms and conditions. We recommend reviewing your airline’s policies before departure.

4. Guest Information

The names provided for booking must match your passport exactly. We require full passport details and dates of birth for all travelers. Any errors or omissions in the provided information that require corrections may result in additional fees, and in some cases, new tickets may need to be purchased.

5. Travel Insurance

We highly recommend purchasing a travel protection plan that covers trip cancellations, interruptions, medical emergencies, and baggage loss. This coverage can protect you from non-refundable expenses and provide peace of mind during your travels. We are not responsible for any costs incurred due to inadequate insurance coverage.

Travel insurance should include a minimum medical, evacuation, and repatriation coverage of USD $200,000, covering all applicable dates of travel with African Lux Safaris and any third-party operators, charter vessels, or tour operators that are part of your travel program (“Medical Emergency Travel Insurance Coverage”). This insurance should cover personal injury and emergency medical expenses. You represent and warrant to African Lux Safaris that you will obtain the required Medical Emergency Travel Insurance Coverage. It is not the responsibility of African Lux Safaris to verify the quality or existence of your insurance coverage.

We strongly recommend purchasing trip cancellation insurance and baggage insurance. Trip cancellation insurance may be the only source of reimbursement if you need to cancel your participation in a travel program. Without trip cancellation insurance, you will be subject to the cancellation fees outlined in Section 17 of these General Terms and Conditions.

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. African Lux Safaris cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason.

Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You acknowledge that without this coverage, there may be no way to recoup any losses, costs, or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses, howsoever arising, for which trip protection plan coverage would otherwise have been available.

6. Health and Safety

Traveling to certain parts of the world may involve risks. We encourage you to consult with health professionals regarding recommended vaccinations and health precautions before your trip. It is your responsibility to comply with all health requirements and to follow medical advice during your travels.

Travelers must be in good health and physically able to participate in safari activities. It is the traveler’s responsibility to ensure they have all necessary vaccinations and medications before travel.

7. Visa and Passport Requirements

It is your responsibility to ensure that your passport is valid for at least six months after your return date and to obtain any necessary visas. We are not responsible for delays or issues related to visa processing. For up-to-date visa requirements, visit the U.S. Department of State website.

Valid passports are required for travel to most destinations. Check with the appropriate consulate or embassy for the latest visa requirements. It is your responsibility to obtain all necessary documentation for travel, including but not limited to passports, required visas, reciprocity fees, affidavits, immunizations, and vaccinations for entry, departure, and travel to each country or region included in your travel program. African Lux Safaris does not provide advice on travel documents and makes no representations or warranties regarding the accuracy or completeness of information provided on visas, vaccinations, climate, clothing, baggage, or special equipment. You agree that African Lux Safaris is not responsible for any errors or omissions in this information.

8. Flights and Transfers

It is your responsibility to confirm flight details directly with the airline before departure. If you have arranged your own flights, please provide us with your flight information at least 30 days before departure to ensure transfer arrangements are made. Any changes to your flight plans should be communicated to us immediately.

9. Accommodation and Facilities

Accommodation standards and facilities may vary by region and may not match those in the United States. We reserve the right to substitute similar hotels if necessary. Room sizes, amenities, and accessibility may differ, and no refunds will be given for such variations.

10. Sightseeing and Optional Activities

Sightseeing tours are included as per the itinerary. Please be punctual, as tours will depart on time. Optional activities offered by third-party suppliers are subject to their terms and conditions, and any disputes should be directed to the supplier.

11. On-Tour Policies

Smoking is not permitted on any transportation or within indoor or outdoor facilities, subject to local laws. Any physical limitations or special requirements must be communicated to us at the time of booking. While we will make reasonable efforts to accommodate special needs, guests are responsible for their own safety and well-being.

12. Changes to Itineraries

We strive to operate all tours as planned, but circumstances may require modifications to the itinerary, accommodations, or transportation. Any such changes will be made with the intent to maintain the quality and enjoyment of your trip. These changes are not grounds for cancellation or refunds.

We reserve the right to make changes to the safari itinerary as necessary, including but not limited to changes due to weather conditions, wildlife movements, and safety concerns. Any changes will be communicated to travelers as soon as possible.

All prices comprising your travel program are based on current rates of exchange, tariffs, and taxes. African Lux Safaris reserves the right to increase the price of your travel program in the event of:

(i) Increased costs from suppliers associated with your travel program,

(ii) Tariffs and taxes, and

(iii) Fluctuations in foreign exchange markets.

African Lux Safaris also reserves the right to withdraw a tour or any part of it, make alterations to the itinerary or tour inclusions as it deems necessary or desirable, and pass on to tour members any expenditures or losses caused by delays or events beyond its control. Itineraries and arranged sightseeing tours are subject to change at any time due to unforeseen circumstances or circumstances beyond African Lux Safaris’ control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.

If you request a change to your travel component, you acknowledge and agree that any such requested changes may incur additional fees charged to you by African Lux Safaris.

13. Baggage

Weight restrictions may apply on internal and domestic flights. Baggage and personal effects are at the owner’s risk throughout the travel program. It is your responsibility to check with the airline for baggage restrictions applicable to international and domestic flights.

14. Air Transportation

African Lux Safaris will not accept any responsibility for mistakes or errors in airfare bookings made by you or independent third parties. The traveler’s confirmations will have detailed tour information, and it is up to the traveler to ensure the correct arrival and departure flight information from the tour start and end cities. If your program includes our services through an independent agent, they will arrange the best-priced airfare available in the class category you request at the time of your booking. Please note that certain airfares are subject to a service fee. Should you cancel or change your air reservation before or after your departure, cancellation penalties may apply.

Airlines concerned are not to be held responsible for any act, omission, or event during the time passengers are not aboard their aircraft or conveyance. African Lux Safaris is not responsible for changes in airline itineraries or flight times and does not guarantee seat assignments or meal preferences. These are at the discretion of the airline and are subject to availability. Any airline-imposed fees for baggage, changes, seat assignments, or other services are your responsibility.

If your travel program includes flights provided by an independent supplier, the terms and conditions of the airline or operator will apply. African Lux Safaris is not liable for any delays, cancellations, or interruptions to air travel and will not refund or credit you for these occurrences. In the event of a missed connection or any other issue arising with your flights, it is your responsibility to liaise directly with the airline to resolve the matter.

15. Force Majeure

African Lux Safaris will not be liable for any failure to perform its obligations where such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, government restrictions, or other emergencies (“Force Majeure”). In such cases, African Lux Safaris may, at its sole discretion, provide a refund or reschedule your safari for a later date, subject to availability and any applicable fees. You agree to accept any refunds or rescheduling as a full and final settlement.

16. Liability and Indemnity

Your participation in any African Lux Safaris tour is at your own risk. African Lux Safaris, its employees, directors, agents, and affiliates (collectively “African Lux Safaris”) shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the services provided, even if African Lux Safaris has been advised of the possibility of such damages.

You agree to indemnify and hold African Lux Safaris harmless from and against any and all claims, damages, losses, liabilities, and expenses, including legal fees, arising from or related to your use of the services, your breach of this Agreement, or your violation of any rights of a third party. This indemnification shall survive the termination of this Agreement.

African Lux Safaris does not own or operate any accommodations, airlines, restaurants, transportation providers, or other suppliers of services connected with your tour, and as such, cannot be held liable for any negligence or breach of contract by any such third party. Any claims regarding the failure or negligence of such third-party suppliers must be addressed directly with them.

17. Cancellation Policy

If you need to cancel your safari, you must notify us in writing. The effective date of the cancellation will be the date we receive your written notification. Cancellation fees apply based on the following schedule:

Cancellation charges are based on cancelled bookings and/or reduction in days or persons of the full travel tour program cost:

    • More than 90 days before departure: Loss of 30% deposit.
    • 90-61 days before departure: 50% of the total travel tour program cost.
    • 60 days or less before departure: 100% of the total travel tour program cost.

 

Please note that certain services, such as internal flights or special accommodation arrangements, may be non-refundable regardless of the cancellation date. We highly recommend purchasing travel insurance to protect against unforeseen cancellations.

18. Amendments and Changes

Any amendments or changes to your booking requested by you after confirmation may incur additional fees. While we will do our best to accommodate your requests, certain changes may not be possible. All change requests must be submitted in writing and are subject to approval by African Lux Safaris.

19. Photography and Marketing

During your safari, African Lux Safaris and its representatives may take photographs or video recordings of you and your travel companions. By participating in an African Lux Safaris tour, you grant us permission to use these images and recordings for marketing and promotional purposes, without compensation. If you do not wish to be photographed or recorded, please inform us in writing before the start of your tour.

20. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California. You agree to submit to the personal jurisdiction of such courts and waive any objections to venue.

21. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

22. Entire Agreement

This Agreement constitutes the entire agreement between you and African Lux Safaris with respect to the subject matter herein and supersedes any prior agreements, representations, or understandings, whether written or oral, relating to your safari booking.
